Terms of Service

These Terms of Service (hereinafter referred to as the “Terms”) set forth the conditions for using the services (hereinafter referred to as the “Service”) provided on this website by Yamatoya Honten Co., Ltd. (hereinafter referred to as the “Company”). All registered users (hereinafter referred to as the “Users”) shall use the Service in accordance with these Terms.

Article 1 (Application)

  1. These Terms shall apply to all relationships between the User and the Company regarding the use of the Service.
  2. The Company may establish various rules and provisions related to the Service in addition to these Terms (hereinafter referred to as “Individual Provisions”). Regardless of their name, such Individual Provisions shall constitute a part of these Terms.
  3. In the event of any inconsistency between these Terms and the Individual Provisions, the Individual Provisions shall prevail unless otherwise specified.

Article 2 (User Registration)

  1. User registration shall be completed when an applicant agrees to these Terms, applies for registration through the method designated by the Company, and the Company approves the application.
  2. The Company may refuse a registration application at its discretion without disclosing the reason if the applicant:
    1. Submits false information
    2. Has previously violated these Terms
    3. Is otherwise deemed inappropriate for registration by the Company

Article 3 (Management of User ID and Password)

  1. Users shall manage their User ID and password at their own responsibility.
  2. Under no circumstances may users transfer, lend, or share their user ID and password with any third party. The Company will deem any login using a user ID and password combination that matches the registered information to be usage by the registered user themselves.
  3. The Company shall not be liable for any damages caused by unauthorized use unless there is willful misconduct or gross negligence on the part of the Company.

Article 4 (Sales Contract)

  1. A sales contract shall be established when the User applies for a purchase and the Company notifies acceptance. Ownership of the product shall transfer to the User upon delivery to the shipping carrier.
  2. The Company may cancel the contract without prior notice if:
    1. The User violates these Terms
    2. The product cannot be delivered due to unknown address or long absence
    3. The relationship of trust between the User and the Company is deemed damaged
  3. Payment methods, shipping, cancellations, and returns shall be governed separately by rules established by the Company.

Article 5 (Intellectual Property Rights)

All copyrights and other intellectual property rights related to product images and other content provided by the Service belong to the Company or legitimate rights holders, and Users may not use them without permission.

Article 6 (Prohibited Conduct)

Users shall not engage in the following acts:

  1. Acts that violate laws or public order and morals
  2. Criminal acts or acts related thereto
  3. Infringement of intellectual property rights
  4. Destruction or interference with servers or networks
  5. Commercial use of information obtained from the Service
  6. Acts interfering with the operation of the Service
  7. Unauthorized access
  8. Collection or accumulation of personal information of other users
  9. Impersonation of others
  10. Providing benefits to anti-social forces
  11. Any other acts deemed inappropriate by the Company

Article 7 (Suspension of the Service)

  1. The Company may suspend or interrupt the Service without prior notice if:
    1. System maintenance is required
    2. Force majeure such as natural disasters occurs
    3. System or communication failures occur
    4. Any other case where provision of the Service becomes difficult
  2. The Company shall not be liable for any damages caused thereby.

Article 8 (Usage Restriction and Deregistration)

  1. The Company may restrict use or cancel registration without notice if:
    1. In the event of a violation of any provision of these Terms
    2. If it is discovered that any of the registered information contains false statements
    3. If the credit card registered by the user as a payment method is suspended
    4. In the event of a default in payment obligations such as fees
    5. If there is no response to our communication within a specified period
    6. Regarding this service, if there is no usage for a certain period after the last use

Article 9 (Withdrawal)

Article 12 (Amendment of the Terms)

The Company may modify these Terms without notice. Continued use after changes constitutes acceptance of the revised Terms.

Article 13 (Handling of Personal Information)

Personal information shall be handled appropriately in accordance with the Company's Privacy Policy

Article 14 (Notices and Communications)

All notices between the User and the Company shall be made by methods designated by the Company. Notices shall be deemed received at the time of dispatch.

Article 15 (Prohibition of Assignment)

Users may not transfer their contractual position or rights or obligations under these Terms without prior written consent of the Company.

Article 16 (Governing Law and Jurisdiction)

  1. These Terms are governed by Japanese law. The CISG does not apply.
  2. Any disputes related to this Service shall be subject to the exclusive jurisdiction of the court with authority over the Company’s head office.
